1. Acceptance of terms
These Terms of Service (the "Terms") form an agreement between you and Vantisco S.R.L.S. ("QoreSafe", "we", "us") and govern your access to and use of the QoreSafe QHSE platform (the "Service"). By creating a workspace, signing in, or using the Service, you agree to these Terms. If you are agreeing on behalf of an organisation, you represent that you are authorised to bind that organisation.
2. Accounts and tenants
The Service is multi-tenant: each organisation operates an isolated workspace (a "tenant"). You are responsible for the accuracy of your account information, for safeguarding your credentials, and for all activity under your account. Tenant administrators are responsible for managing users, roles, and data within their workspace.
3. Acceptable use
You agree not to:
- use the Service in violation of any applicable law or regulation;
- upload unlawful, infringing, or malicious content, or attempt to breach tenant isolation or access another tenant's data;
- probe, scan, or disrupt the integrity or performance of the Service;
- reverse engineer the Service except to the extent permitted by law.
4. Customer data
You retain all rights to the data you submit to the Service ("Customer Data"). You grant us a limited licence to host and process Customer Data solely to provide and support the Service. Our processing of personal data within Customer Data is governed by our Privacy Policy and Data Processing Addendum.
5. Intellectual property
The Service, including its software, design, and content (excluding Customer Data), is owned by Vantisco S.R.L.S. and its licensors and is protected by intellectual-property laws. Except for the rights expressly granted here, no rights are transferred to you.
6. Disclaimers
The Service supports your QHSE management but does not constitute legal, safety, or compliance advice, and does not guarantee regulatory compliance. The Service is provided "as is" and "as available" without warranties of any kind, whether express or implied, including merchantability, fitness for a particular purpose, and non-infringement, to the maximum extent permitted by law.
7. Limitation of liability
To the maximum extent permitted by law, neither party will be liable for indirect, incidental, special, consequential, or punitive damages, or for lost profits or data. Each party's aggregate liability arising out of or related to these Terms is limited to the maximum extent permitted by applicable law. Nothing limits liability that cannot be limited under applicable law.
8. Term and termination
These Terms apply while you use the Service. Either party may terminate in accordance with the applicable order or subscription. We may suspend or terminate access for material breach. On termination, your right to use the Service ends and Customer Data is handled as described in the Data Processing Addendum.
9. Changes to the Service or Terms
We may update the Service and these Terms from time to time. Material changes will be communicated by reasonable means, and continued use after the effective date constitutes acceptance.
10. Governing law
These Terms are governed by applicable law, without regard to conflict-of-laws principles. Disputes will be heard in a competent court, subject to any mandatory consumer protections.
